GENERAL
Calanthé Studio (org. number 941126-5904, VAT registration number SE941126590401) owns and operates the marketplace calanthestudio.com, hereinafter referred to as Calanthé Studio, whose products are sold to customers.

The purpose of these Terms and conditions is to clarify the agreement you enter when you as a consumer place an order through or use the online store of Calanthé Studio. To shop on calanthestudio.com, you need to be 18 years old or have a parent’s permission.

When you confirm your order, you agree to our Terms and Conditions.

1. PURCHASE
1.1 Order placement
1.1.1 When placing an order on our website, you can choose to create an account. If you do, you are responsible for making sure that all information provided is correct and you are solely responsible for the actions taken in connection with it. You can use this account to place new orders and to track current ones. You add products to your shopping card by clicking "ADD TO BAG".
1.1.2 You can change the contents of your shopping cart until you have confirmed your purchase. Before confirming your purchase, you will be given the opportunity to review your selected products, the information you have given, the total price of the order and be given the chance to correct any orders. When done, confirm the purchase by clicking the "PAY NOW" button. Your order is sent to us when you click the button.
1.1.3 We reserve the right to refuse a customer purchase. All orders are subject to acceptance by us.
1.1.4 When you have completed your order, an order confirmation will be sent to your specified email address. In the confirmation you will find information about the products, price, billing and delivery address.
1.1.5 If there is an error inte the order confirmation, you must notify us immediately. The same goes if any unauthorised uses have been made on your account or any other breaches of security.
1.1.6 Should a product not be available, we will contact you. You can then choose to exchange your purchase to a product that is available, turn it into store credits, or get a cancellation on your order.
1.1.7 All orders are considered binding, If you have placed an order by mistake, you must therefore notify us immediately.
1.1.8 When ordering, an agreement is only made when you as a customer have received an order confirmation via e-mail from us. The order confirmation is automatically generated by our database and is not subject to manual review.

1.2 Price
1.2.1 All prices in the store are automatically stated in SEK and all prices include 25% VAT. You have the option to change the currency to your local one.
1.2.2 We reserve the right to change products and product prices at any time. Reasons for this may be, but are not limited to, a price change from our supplier, misprints in the price list and inaccuracies in the prices due to incorrect information.
1.2.3 If you are ordering from outside the EU, additional import fees may be added. It is your own responsibility as the customer to be informed about these prior to making your purchase, and you alone will be responsible for paying these.
1.2.4 You are obligated to pay all fees and charges on your account or allocated to your order by the due day at latest.

1.3 Payment
1.3.1 Payment is currently made through Visa, Maestro, MasterCard, Google Pay or Apple Pay, We are working on including more payment options.
1.3.2 Calanthé Studio also offers gift cards. When purchased, these are valid as a payment method on the website.
1.3.3 Before placing an order you are obligated to enter a payment agreement with Calanthé Studio. By checking the box in the cart and continue to the checkout page, you are accepting that the full order amount will be processed upon checkout and that your order will be sent to you within 14 days.

2 SHIPPING AND DELIVERY
2.1 Shipping
2.1.1 The estimated delivery time is dependent ont he country and shipping alternative you choose. General delivery time within Europe is 2-7 working days. We offer the following shipping methods: DHL, UPS.

2.2 Shipping cost.
2.2.1 Free delivery to customers is applied to orders over 3000 SEK, within Sweden's borders. For other orders, shipping is added according to our shipping suppliers' price lists.
2.2.2 Free shipping does not apply to home delivery.

2.3 Delivery
2.3.1 We only accept orders with delivery within the countries stated in our Delivery page. We are continuously working on including more countries in this list.
2.3.2 We aim to delivery to you within 1-3 working days from when the product is finished in production. We reserve 14 days of production from when the order is confirmed, after which it will be shipped to you. Depending on what you ordered the production time may be shorter than 14 days.
2.3.3 Should delays in proudction or delivery occur on our part, we will contact you via your provided email address.
2.3.4 We reserve the right to cancel delivery if the ordered product is unavailable. In such a situation, you as a customer will be informed by us via your spified e-mail address.
2.3.5 We reserve the right to extend the production time to longer than 14 days if necessary. If so, we will contact you about the delay.

2.4 Tracking of parcels
2.4.1 Our shipping partners carries out updates on the whereabouts of your parcel after the parcel has left our warehosue. To track your package, visit our shipping parters here: DHL, UPS.

2.5 Uncollected packages
2.5.1 We charge a fee of SEK 300 to cover our overhead costs for unclaimed packages.

2.6 Transport damage
2.6.1 You are obliged to examine the package immediately upon receipt/delivery. Upon delivery of a defective package, you must immediately report this to your chosen shipping carrier and state the error.

2.6.2 Save all products and packaging, so that it can be inspected by the shipping carrier if necessary. Document well, as you may receive a request for photos of the damaged goods/packaging. The sender, in this case us at Calanthé Studio, are of course resposible for ensuring that the shipment has been packed correctly.

3 RETURNS
3.1 As our products are Made to Order and produced only for you as a customer upon received order confirmation, we urge you as a customer not to place an order if you are not sure you want to keep it. If any product ordered would not fit, we offer to make alterations to the product to ensure you as a customer get the fit you want.
3.2 If you still order product(s) that you are not sure you want to keep, you have the right to withdraw your purchase for a full refund within 14 days of receiving your order. You need to have contaced us and returned the product to us before the last day has passed.
3.2.1 You are responsible for return shipping, delivery and condition of the product upon return. The product should therefore be sent well packaged and in its original packaging.
3.2.2 Your right to withdraw your purchase or to exchange a product is under the condition that the product and packaging remains in the same condition from when you receive it until you have sent it back.
3.2.3 If the product has been used or damaged, we reserve the rigth to either deduct from the product's value and amount corresponding to the reduction in value, or to refuse the return all together.
3.2.4 To inform us that you wish to withdraw your order, you must notify us via our customer support at support@calanthestudio.com within 14 days from receiving your order. In your message, your name, address, e-mail address, order number and which products the return applies to must be clearly stated.

4 RETURN EXCEPTIONS
Your right to withdrawal or exchange does not apply to products that has been produced based on your specific requirements. This includes all products with a customised variation or print ad all products with customised measurements. That means that if you have added custom measurements to your order when placing it, you forfeit your right of withdrawal exchange of this product. The right of withdrawal or exchange does also not apply to products that have been sealed for health or hygiene reasons and where the seal has been broken by you. Services that have been completed and where you have expressly agreed to the start of the service without the right of withdrawal are also not covered by the right of withdrawal.

5 COMPLAINT RIGHTS
5.1 We inspect all products before they are sent to you, and all products go through an extensive quality control. Should the products still be damaged or faulty when it arrives, we undertake to rectify the fault free of charge. By law, you as a customer have the right to complain for three years from the time of purchase, providing that you inform us about the defect in a timely manner from when the fault has been discovered.
5.2 As a customer, you must contact us immediately after the defect has been discovered. Any inaccuracies must be reported via our customer support, support@calanthestudio.com, where you enter your name, address, e-mail address, order number, product name, a description of the error and a picture of the defect.
5.3 You must always contact us for approval before returning a defective product. After approval, you are responsible for returning the product to us if nothing else is agreed. It is then your responsible to make sure to pack teh product properly so no further damage occur during transportation.
5.4 Returns made within two months from the discover of the fault are considered returned within a reasonable tine. For a product to be considered faulty, the defect must have occurred before it was sold. Up to two years from purchase the fault is assumed to have occurred before it was sold unless us, Calanthé Studio, proves otherwise. If more than two years has passed from the point of purchase, you as the consumer are reponsible to show proof that the fault on the product occurred before the point of sale.
5.5 Your claim is subject to either repair, replacement or refund. If we are unable to remedy the fault or supply with a similar product, we will refund you for the defective product in accordance with applicable customer protection legislation.
5.6 We reserve the right to deny a complaint if it turns out that no fault is discovered on teh product upon inspection. We, Calanthé Studio, will then charge you a fee for the cost of returning the item to you.
5.7 If there is any reason to suspect fraud, this will be reported to the authorities. If such a suspicion is connected to your claim, we reserve the right not to process your claim.

6 REFUNDS
6.1 In case of withdrawal, you as a customer can make a request for a refund. This will be initiated automatically after your return has been accepted.
6.2 To be eligible for a refund, you must follow the rules of withdrawal. That is, if you have contacted us about that you wish to withdraw your order, and your return has returned to us within 14 days from receiving your order. Once your product has been received and inspected, we will send you and email to let you know that we have received your return. We will also notify you of approval or rejection of the return.
6.3 If the return is approved, your refund will be processed, and a credit will be applied to your original payment method. We cannot refund to an account other than the account from which the payment was made. From the point where the return is approved by us, we reserve up to 14 days to process the refund.
6.4 If the product is rejected because it has been used or damaged, we reserve the right to either deduct from the product's value an amount corresponding to the reduction in value, or to refuse the return and refund all together.
6.4.1 If the return and refund is refused all together, we, Calanthé Studio, will then charge you a fee for the cost of returning the item to you.

7 REFUND EXCEPTIONS
If your withdrawal or claim has been accepted, please note that the refunding value is only the product value. Other fees such as shipping fees or import fees if you ar ordering from outside the EU, are not included and will not be refunded.

8 LIMITATION OF LIABILITY
8.1 We take no responsibility for indirect damages that may arise due to the product.
8.2 We take no responsibility for delays/errors because of circumstances beyond the company's control (Force Majeure). These circumstances can be, for example, a labor dispute, fire, war or authority decision.
8.3 Furthermore, no responsibility is taken for any changes to products/products characteristics that have been changed by the respective supplier and other factors beyond our control. When we are informed of updates by our suppliers, we update the online store as soon as we can.

9 PRODUCT INFORMATION
We reserve the right for any errors regarding to product rendering in our online store, social media, newsletters, printed and digital advertising. We do not guarantee that the images reflect the exact appearance of the products as a certain color difference may occur depending on the monitor, photo quality and resolution. We always try our best to expose the products as correctly as possible.

10 INTELLECTUAL PROPERTY
All trademarks, designs, graphics and logos and all other intellectual property rights on the website are solely in the ownership of Calanthé Studio. Your use of this website gives you no right to reproduce or copy any intellectual property listed above.

11. GOVERNING LAW
This agreement is governed under Swedish law, and in cases of dispute the issuing law will be Sweden's.

In the event of a dispute, it is our policy to always follow the Swedish General Complaints Board's recommendations. You can find them at https://www.arn.se/

12. CHANGES AND AMENDMENTS
We reserve the right to modify this Terms and conditions at any given time. Your continued use of the website and our products after the modification have been put in place will constitute you consent to the changes made. Any changes will be directly shared on our website and the latest reviewed date will be presented on the below timestamp.
